Consumer Health Data Privacy Policy

This policy is provided under the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Law, and the Connecticut Data Privacy Act's consumer health data provisions. It applies to "consumer health data" handled by Skinwise and supplements our general Privacy Policy. Where this policy and the general policy differ regarding consumer health data, this policy controls.
1. Categories of consumer health data we collect
- Photographs of skin that you choose to submit for educational analysis;
- Photographs of skincare product labels you choose to submit;
- AI-generated educational information derived from those photos (e.g., observations, scores, suggestions);
- Health-adjacent profile details you optionally provide (e.g., skin tone, gender);
- Care plans, progress logs, and scan history you create in the app;
- Messages you send to the in-app AI advisor that may describe health conditions;
- Momentary location data (only with your permission) used to provide UV guidance, which could be considered health-adjacent.
2. Sources
All consumer health data comes directly from you — the photos you take or upload, the text you type, and the optional profile details you enter. We collect no health data from third parties and draw no health inferences from non-health data.
3. Purposes of collection and use
Consumer health data is collected and used solely to provide the services you request: generating the educational analysis of a photo you submit, answering the advisor questions you ask, displaying your own history and plans back to you, and providing local UV guidance. We do not use consumer health data for advertising, marketing, profiling, or any secondary purpose.
4. Categories of consumer health data shared, and with whom
- Processor — Anthropic, PBC: receives the photos and text you submit, solely to generate your result, under contractual terms that prohibit any other use. Photos are not retained by us and are not used to train AI models.
- Processor — Cloudflare, Inc.: operates the server that relays your request; photos pass through encrypted and are not stored or logged.
Affiliates: none. SkinGuard LLC has no affiliates, and no affiliate receives consumer health data.
Selling: we do not sell consumer health data and will not do so. (Any future sale would require your separate, signed authorization, which we will never request.)
5. Consent
We collect consumer health data only with your opt-in consent, given when you accept the health-data consent at signup and each time you affirmatively choose to submit a photo or message. Consent for collection is obtained separately from our general Terms of Use. We do not share consumer health data with anyone other than the processors above, which act on our instructions to deliver the service you requested.
6. Your rights
- Right to know / access: confirm whether we collect your consumer health data and receive a list of the third parties (above) with whom it is shared, including contact information.
- Right to withdraw consent: stop submitting scans at any time, revoke camera/location permissions in device settings, or email us to withdraw consent entirely.
- Right to delete: delete individual scans in the app, delete your account in Settings → Account, or use our account deletion page. Deletion removes data from our systems, including backups, within the timelines the law allows.
- Right to appeal: if we deny a request, reply to our decision and we will review the appeal within 45 days and explain the outcome. If unsatisfied, you may contact your state Attorney General.
How to exercise rights: email skin.guard.llc@gmail.com from the email address on your account (this is how we verify identity — you will never be required to create a new account). We respond within 45 days.
7. No geofencing
Skinwise does not use geofencing of any kind, and does not use location data to identify, track, or send notifications related to any health facility.
